In Aurora businesses must understand “nexus” to determine their tax obligations. Nexus refers to the connection that requires a business to collect sales tax in a state. This concept became even more important after the U.S. Supreme Court’s decision in South Dakota v. Wayfair, Inc., which allowed states to require sales tax collection based on economic activity rather than just a physical presence.
Specific sales tax rules for Aurora
The Occupational Privilege Tax will be repealed effective January 1, 2025, following the passage of Ordinance 2022-77. Businesses must continue to collect and pay this tax until the repeal date. The repeal will be implemented unless altered by future City Council decisions, and updates will be provided as the date approaches to inform businesses and individuals about the impact and necessary actions.The Lodger’s Tax exemption, effective June 1, 2021, now clarifies that it only applies to individuals, not businesses. A business renting a room for over 29 consecutive days cannot claim the exemption. The exemption is valid only if a natural person occupies the room for the specified period.Effective December 1, 2019, cigarettes are subject to sales tax, eliminating their previous exemption. Retailers must collect the City of Aurora’s sales tax rate of 3.75% on cigarettes and remit it with their regular sales and use tax filings.
