Supreme Court Strikes Down IEEPA Tariffs: A $170 Billion Refund Opportunity for Importers
On February 20, 2026, the Supreme Court ruled 6–3 that the President cannot impose tariffs under IEEPA, invalidating “drug trafficking” and global reciprocal tariffs introduced since 2025. The Court held that tariff powers belong to Congress. The decision may trigger up to $170 billion in refunds. IEEPA duties have ended, but a new 15% temporary surcharge under Section 122 now applies to most imports, with key exemptions.
